A Conservative councillor accused of saying all homosexuals were paedophiles is still waiting to hear if he will face criminal charges.
Peter Willows, 75, who represents Hangleton and Knoll Ward on Brighton and Hove City Council, was last month interviewed by police investigating his remarks.
The matter was passed to the Crown Prosecution Service which is currently deciding whether an offence has been committed under the Public Order Act.
A spokesman said: "CPS Sussex confirms that it has received a file from the police in respect of allegations concerning Peter Willows.
"This file will be reviewed in line with the code for crown prosecutors and a decision will be made as to whether criminal charges will be laid against him."
The long-serving councillor was widely condemned after allegedly making the comments in May when he was among 200 guests attending a reception hosted by the mayor at the Royal Pavilion.
When he was later confronted by The Argus he said he was drunk and added: "I don't have the same hatred for the gay community that I do for paedophiles. But I don't like them."
Gay activists criticised the decision to allow the councillor to carry on representing his ward while the police investigation continues.
The Conservative group on the city council did suspend him from council committees pending the outcome of the investigation.
There have been calls for his resignation by leading members of the gay business community who signed an open letter to The Argus stating: "He is not fit to make decisions which affect the city's 35,000 LGBT (lesbian, gay, bisexual and transgender) population."
