A family is taking its battle against supermarket giant Tesco to the House of Lords.
Linda and Phil Pollard, of Horsham, have been fighting the company since their son Connor, now nine, ate dishwasher powder from a bottle with a faulty safety cap aged 13 months.
His throat shrank to the size of a pin hole and he was on a life-support machine for a week. He had 40 operations to repair damage to his oesophagus and will never make a complete recovery.
The family's Court of Appeal case against the firm failed earlier this month when a judge ruled that although the cap had been faulty it was still harder to take off than a screw cap.
A judge said there had been no negligence on the part of Tesco, which sold the powder, or manufacturer Robert McBride Ltd.
But a barrister who has been examining the case notes has given the family hope that an appeal to the House of Lords could succeed. Mr Pollard, of Broome Close, Horsham, said: "He's come back with a really strong case."
