Fisherman Clive Mills could go to prison after ignoring a court order.
Mr Mills was ordered to leave land at Norfolk Wharf, on the River Arun, Littlehampton, on August 1 after he lost a hearing at Worthing County Court.
Mr Mills lost his right to moor his boat, Lady Lena, on the site and is now trespassing on the land.
Court officials served papers to Mr Mills at his home in Bognor Regis on Monday night and he is due back before the county court on September 14.
Mr Mills faces legal costs of more than £20,000 after he lost his court case against Arun District Council.
Plans have been drawn up to build a multi-million pound development on the site where he moored his boat including housing, a pub/restaurant, a youth hostel and a visitor centre.
Arun Council says it has offered Mr Mills four alternative sites but he has refused them all.
Mr Mills was today unavailable for comment.
