Plans to pull down a Regency listed building and replace it with modern flats have been approved.
The Planning Inspectorate overturned Brighton and Hove City Council's decision to reject redevelopment plans for the fire-damaged property in King's Road, near Regency Square.
Beach Properties Sussex will now be able to put up the replacement building with seven, self-contained flats.
The building dates from 1825 but is in a poor condition.
Most councillors felt the replacement should be in the form of a replica rather than the contemporary solution proposed.
A report from the inspectorate called the new design uncompromisingly modern but said it was well proportioned and carefully considered for its setting.
The inspectorate said copying the facade would create a false appearance and would miss the opportunity to allow the area to evolve in response to modern needs.
