Councillors have abandoned plans to take their fight for a breast care unit before a judge.
Mid-Sussex district councillors previously claimed a decision to keep the breast care unit in Brighton, was undemocratic.
The officials, who wanted the facilities moved to Haywards Heath, objected to the use of an oral vote.
They felt the Primary Care Trust had been pressurised into accepting the action of Brighton and Hove City and Mid Sussex Primary Care Trusts and proposed to apply for a judicial review.
But councillors have now decided not to send a pre-action letter, which would have been the first step to applying for a judicial review.
Councillor David Russell said: "Members decided it was probably not a very good idea. This was largely due to the cost involved and also the likelihood of success."
The council is still looking into other ways of objecting to the decison to have the unit at Rosaz House.
A letter has been written to the Secretary of State asking him to investigate the decison.
