The owners of a kebab shop and shisha lounge have been asked to remove decking and a canopy that they built without planning permission.

The owners of Hove-based Nayeb Kebab House built an enclosed extension on the pavement in Church Road in early 2023. Despite Brighton and Hove City Council officers informing the owner of their intention to investigate this, when they opened Nayeb Shisha House three doors down, they built more shelters.

Now, the council has served enforcement notices on both addresses requiring them to be removed.

“The notice specified this work needed to be completed within ten months of a specified date, which was in February this year.

“The owner has subsequently appealed to the government’s Planning Inspectorate and we have provided our representation.

“This appeal is now being dealt with by the Planning Inspectorate and the notice is on hold, but we have been told there are currently delays in these cases being processed.

“If the eventual decision is that the appeal is dismissed and the enforcement notice is upheld, the extension will need to be removed within 10 months.”

Manager Eskandar Hajezadah said: “We didn’t know about the planning permission but we have spent a lot of money and it has helped our business a lot. We would really like to keep it – we’ve not heard a bad comment about it from customers or locals. I wouldn’t even know how to remove it.”

He added that they are happy to apply for planning permission retrospectively.
