The statue of a legendary comic could be finally given a permanent home.
A bronze life-size depiction of Max Miller has been earmarked for a corner of the Pavilion Gardens in New Road, Brighton opposite the access road leading to the Brighton Dome.
It will be angled in such a way that the image of the Brighton-born star will be looking at the old Empire Music Hall on the west side of the road, where he originally performed.
The statue became the subject of controversy after it was sited outside the main entrance to the Pavilion Theatre, part of the Brighton Dome.
It had originally been unveiled in North Road in May 2005 but later removed for major work along New Road.
The Dome objected to its new placement because it would have obstruct the busy entrance to the box office and stage door and suggested the figure would be better placed on the seafront near the Palace Pier.
These suggestions did not go down well with members of Brighton's Max Miller Appreciation Society, who raised money to pay for the statue and said 'Max' belonged in the theatre and entertainments hub of New Road.
A compromise was reached to place the statue somewhere else in New Road and a decision on the most recent planning application will be made by Brighton and Hove City Council.
