Musician Graham Coutts, whose conviction for murdering Brighton schoolteacher Jane Longhurst was ruled unsafe by the Law Lords in July, must face a retrial, the Court of Appeal held today.
Three judges formally quashed Coutts's conviction and said he should be recharged on a fresh indictment within two months and retried at the Old Bailey.
Coutts, who was in the dock at the Appeal Court to hear the decision, remains in custody, although he may apply to the Old Bailey for bail.
Coutts, 36, of Waterloo Street, Hove, was jailed for life at Lewes Crown Court in February 2004 for the murder of 31-year-old Miss Longhurst, a special needs teacher, in March 2003.
